Terms and Conditions (T&Cs) for The Eleventh Agency
Effective Date: November 11, 2025
Please read these Terms and Conditions carefully. They represent the legally binding agreement between The Eleventh Agency (referred to as "The Agency" or "Planner") and the Wedding Couple/Event Contact (referred to as "Client").
By accepting our proposal and signing our contract, the Client agrees to be legally bound by these conditions.
1. Scope of Agreement and Agency Responsibility
This contract follows your confirmation to secure The Eleventh Agency as a professional event planning service to assist in the planning and execution of services outlined in the itemised invoice.
Key Planner Responsibilities
Service Delivery: The Agency's commitment includes all items and services as outlined in the final itemised invoice issued.
Professional Advisor Role: The Planner understands their role will be that of a professional advisor and coordinator. The Client will make all final decisions pertaining to the selections of supplier/service providers.
On-the-Day Judgment: The Planner will use their professional judgment when taking action in regards to late changes, weather, tardiness, and non-performance based on the situation, time limitations, and/or Client wishes.
Supplier Substitution: In the event of any supplier/service provider’s cancellation, The Agency may substitute a new supplier/service provider at our discretion. Any additional costs incurred will be payable by the Client.
Media and Photography Rights
The Client grants The Agency the right to use their event photographs (including ceremony, reception, or event images) for promotional activities on our official website and associated social media platforms.
The Agency will seek separate, direct consent from the Client for the employment of these photographs in any advertising endeavours that extend beyond our official website and directly affiliated social media accounts.
The Agency gives permission for the Client to use any photographs/videos in which the event/wedding planner appears.
2. Client Responsibilities
Financial and Administrative Duties
Initial Payment: The Client is responsible for the Save the Date payment as per this contract. Failure to receive payment within ten (10) working days of the invoice date reserves The Agency's right to cancel the contract.
Information Provision: The Client is responsible for providing The Agency with all relevant contact details pertaining to any pre-organised arrangements, including scheduled time tables, package inclusions, and other relevant information.
Change Notification: The Client is responsible for notifying The Agency of any changes or amendments required in a timely manner. The Agency will not be held liable to any changes made by the Client or their selected service providers. Any cancellation or amendment fees will be payable by the Client.
Event Day Logistics
Overtime: In the circumstance that The Agency is required to, or forced to, exceed our agreed contracted hours on location, the Client will be invoiced post-event for this additional time at the hourly rate.
Venue Setup: Venue configuration setup and changes must be conducted only by The Eleventh Agency staff or authorised suppliers.
3. Hire/Rental Agreement
Additional Fees: All hire items fees are payable in addition to planning and coordination packages.
Quotation Subjectivity: All quotations from The Agency for hire items are subject to availability and price change.
Hire Period: All prices quoted are for single day hire.
Client Responsibility for Damages: Upon signing the terms and conditions of hire, the Client is responsible for any damages sustained to items during the hire period. This also applies to any items not returned at the end of the hire period.
Wet Weather: In the event of wet weather, The Agency will relocate all hire equipment to an alternate destination. There will be no compensation offered for change of venue or if The Agency cannot fulfil the agreement due to poor weather.
4. Deposit and Payments (WEDDINGS)
Payment Schedule (Key Deadlines)
Initial Deposit (Non-Refundable): 20,000,000.00 IDR is payable within seven (7) working days of accepting of this contract to secure the event date. Services will not commence until this payment is received.
First Progress Payment: 25% of the total remaining balance is due at 2 months after the initial deposit.
Second Progress Payment: 25% of the total remaining balance is due at 6 months from the event date.
Final Payment: The total remaining balance is due no later than 1 month from the event date.
General Payment Policy
Final Guest Numbers: Final guest numbers for catering and furniture quantities must be confirmed no later than one (1) month prior to the commencement date.
Payment Due: Payment is due within 7 days of issue. Services will not commence until funds have cleared.
5. Change and Cancellation
Modification and Postponement
Modification: This agreement can only be modified in writing and all changes must be agreed and signed by all parties, or by the acknowledgement of email received by both parties.
Date Change: The Client agrees that in the event of a date change, any expenses including deposits and fees that are non-refundable and non-transferable are the sole responsibility of the Client. Cancellation fees still apply to the original date of the event.
Cancellation by Client
In the event of a cancellation by the Wedding Couple/Event Contact, the following cancellation fees apply:
6 to 12 months out from the event date: Client loses 50% of payments made.
Within 4 months out from the event date: Client loses 100% of payments made (as The Agency cannot sell this date again).
Cancellation by The Eleventh Agency
Should The Agency be unable to perform any specific tasks due to death, illness, hospitalization, or any other event beyond its control, the value of time not expended will be refunded, and we will do our best to find a substitute planner. The Client will have no claim against The Agency other than to the extent of the refund of the value of time not expended.
6. Indemnity and Liability
Client Indemnity: The Client and its representatives agree to accept any and all liabilities that may be associated with the event being held (including personal or bodily harm of guests or damages) and holds The Eleventh Agency harmless from the same.
Vendor Liability: The Agency will always endeavour to find the best and most reliable suppliers but cannot be held responsible for any supplier/service provider’s performance or product.
Acts of Nature/Force Majeure: The Agency is not responsible for any circumstances preventing the event to happen, including fire, flood, earthquake, or any other natural or human acts. If the event is forced to be cancelled due to circumstances beyond the control of The Agency, The Agency will only require payment for the expended time spent planning and any non-refundable out-of-pocket expenses.
Important note: If you have paid the deposit for your wedding to PT PMA The Eleventh Agency, you are agreeing to be bound by these Terms and Conditions.
